Protide Health Corporation (“Protide Health,” “Company,” “we,” “us,” or “our”) is committed to protecting the privacy and security of our Users’ personal information. This Privacy Policy describes how we collect, use, disclose, store, and protect information when you visit or make a purchase from our website at protidehealth.com (the “Website”). This Privacy Policy is incorporated by reference into our Terms and Conditions of Website Use (the “Agreement”). Capitalized terms used but not defined herein have the meanings assigned to them in the Agreement.

By accessing the Website, creating an account, or placing an order, you consent to the practices described in this Privacy Policy. If you do not agree with this Privacy Policy, please do not use the Website.

1. INFORMATION WE COLLECT

1.1 Information You Provide to Us

We collect personal information that you voluntarily provide when you interact with the Website, including:

  • Payment Information: credit card numbers, debit card numbers, and other financial account information necessary to process transactions. Payment card data is processed and stored by our third-party payment processors and is not stored on Protide Health’s servers.

We cannot guarantee absolute security and the User acknowledges and accepts this inherent risk. In the event of a data breach involving personal information, Protide Health will notify affected Users and applicable regulatory authorities as required by law.

The Website uses cookies, pixels, web beacons, and similar tracking technologies to improve functionality, analyze traffic, remember User preferences, and support marketing efforts.

5.1 Types of Cookies We Use

  • Essential Cookies: required for the Website to function properly, including shopping cart functionality, account authentication, and security features. These cookies cannot be disabled without affecting Website functionality.

6. DATA RETENTION

Protide Health retains personal information for as long as necessary to fulfill the purposes for which it was collected, including to satisfy legal, accounting, tax, or reporting requirements. Specifically:

  • Order and Transaction Records: retained for a minimum of seven (7) years to comply with tax and financial reporting obligations.
  • Account Information: retained for the duration of the User’s account and for a reasonable period thereafter to allow for account reactivation or to resolve any outstanding issues.
  • Marketing Preferences: retained until the User opts out or requests deletion.
  • Website Usage Data: retained in aggregated, anonymized form for analytics purposes.

When personal information is no longer required for any legitimate purpose, we will securely delete or anonymize it.

7. MARKETING COMMUNICATIONS AND OPT-OUT

With your consent (where required by law) or based on a legitimate interest in providing relevant information about our Products, Protide Health may send you marketing emails, including newsletters, product announcements, educational content, and promotional offers.

How to Opt Out: You may opt out of marketing communications at any time by: (a) clicking the “Unsubscribe” link at the bottom of any marketing email; or (b) contacting us at support@protidehealth.com with the subject line “Unsubscribe.” We will process your opt-out request within ten (10) business days.

Transactional Communications: Opting out of marketing communications will not affect transactional messages related to your orders, including order confirmations, shipping notifications, payment receipts, and account security alerts. These communications are necessary for order fulfillment and cannot be opted out of while maintaining an active account.

8. SMS / TEXT MESSAGE COMMUNICATIONS AND CONSENT (TCPA COMPLIANCE)

This Section describes the terms governing SMS text messages sent by or on behalf of Protide Health in connection with orders placed through the Website. This Section constitutes our SMS/Communications Consent Disclosure and satisfies applicable Telephone Consumer Protection Act (TCPA) requirements.

8.1 Purpose of SMS Communications

Protide Health and its third-party payment processors and communication service providers may send SMS text messages to the phone number you provide at checkout for the following purposes:

  • Payment Verification: One-Time Password (OTP) codes sent by our credit card processor to verify your identity and authorize payment transactions.
  • Order Confirmation: Messages confirming that your order has been received and is being processed.
  • Shipping Notifications: Messages providing shipping confirmation, tracking information, and delivery updates.
  • Fulfillment Updates: Messages regarding order status changes, delays, out-of-stock notifications, or other order-related communications.
  • Account Security: Messages related to account security, password resets, or suspicious activity alerts.

8.2 Your Consent

By entering your phone number at checkout, checking any applicable consent box, and/or clicking “Place Order,” you expressly consent to receive automated SMS text messages from Protide Health and its service providers at the phone number you provided. You confirm that you are the account holder or authorized user of the phone number provided. Your consent is given in compliance with the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, and applicable Federal Communications Commission (FCC) regulations.

Consent to receive marketing or promotional SMS messages is not required as a condition of purchasing any Product from Protide Health. However, if you choose to pay by credit card, consent to receive transactional OTP verification messages from our payment processor may be required to complete the transaction. Alternative payment methods (Venmo, Cash App, Zelle, cryptocurrency) are available for Users who do not wish to receive SMS verification messages.

8.3 Message Frequency and Rates

Message frequency varies based on your order activity. A typical order generates approximately two to five (2-5) SMS messages, including OTP verification, order confirmation, and shipping notifications. Users who place multiple orders will receive proportionally more messages.

Standard message and data rates from your wireless carrier may apply. Protide Health is not responsible for any messaging or data charges imposed by your wireless carrier. Contact your wireless carrier for details regarding your plan and any applicable charges.

8.4 How to Opt Out of SMS

Promotional/Marketing Messages: If Protide Health sends promotional SMS messages, you may opt out at any time by replying STOP, UNSUBSCRIBE, CANCEL, END, or QUIT to any promotional message, or by emailing support@protidehealth.com with the subject line “SMS Opt-Out” including the phone number you wish to remove.

Transactional Messages: Transactional messages (OTP verification, order confirmations, shipping notifications, and security alerts) are necessary for order processing and account security. These cannot be separately opted out of while maintaining a credit card payment method or an active order. To stop receiving all SMS messages, you may use an alternative payment method that does not require OTP verification, or contact support@protidehealth.com to request removal of your phone number from our records. Removing your phone number may affect our ability to provide order updates and security notifications.

8.5 Supported Carriers

SMS messages are supported by all major U.S. wireless carriers, including but not limited to AT&T, Verizon, T-Mobile, U.S. Cellular, and their subsidiaries and MVNOs. Carrier availability is not guaranteed, and message delivery may be affected by carrier network conditions, device compatibility, and other factors outside Protide Health’s control.

If you experience any issues with SMS messages, reply HELP to any message from Protide Health for assistance, or email support@protidehealth.com with the subject line “SMS Support.”

9. YOUR PRIVACY RIGHTS

9.1 California Residents (CCPA/CPRA)

If you are a California resident, you have the following rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA):

  • Right to Know: You have the right to request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources from which the information was collected, the business or commercial purpose for collecting the information, and the categories of third parties with whom we share the information.
  • Right to Delete: You have the right to request that we delete personal information we have collected from you, subject to certain exceptions (e.g., information necessary to complete a transaction, comply with a legal obligation, or detect security incidents).
  • Right to Correct: You have the right to request that we correct inaccurate personal information that we maintain about you.
  • Right to Opt Out of Sale/Sharing: Protide Health does not sell or share personal information for cross-context behavioral advertising as defined under the CCPA/CPRA. Accordingly, there is no need to submit an opt-out request for the sale or sharing of personal information.
  • Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA/CPRA rights. We will not deny you goods or services, charge different prices, provide a different level or quality of service, or retaliate in any way for exercising your rights.

9.2 Residents of Other States

Residents of Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, and other states with comprehensive consumer privacy laws may have similar rights, including the right to access, correct, and delete personal information, the right to opt out of targeted advertising and the sale of personal information, and the right to appeal a denial of a privacy request. Protide Health will honor these rights to the extent required by applicable law.

9.3 Exercising Your Rights

To submit a privacy rights request, contact us at support@protidehealth.com with the subject line “Privacy Rights Request.” Please include your full name, email address associated with your account, and a description of the right(s) you wish to exercise. We will verify your identity before processing any request and will respond within the timeframes required by applicable law (generally 45 days for CCPA/CPRA requests, extendable by an additional 45 days with notice). If we deny your request, we will provide an explanation and information on how to appeal the decision.

10. CHILDREN’S PRIVACY

The Website is not directed to individuals under twenty-one (21) years of age. We do not knowingly collect personal information from anyone under twenty-one (21). If we become aware that we have collected personal information from an individual under twenty-one (21), we will take steps to promptly delete such information. If you believe we have inadvertently collected information from a minor, please contact us immediately at support@protidehealth.com.

11. INTERNATIONAL USERS

The Website is operated from within the United States and is intended for Users located in the United States. If you access the Website from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States, where data protection laws may differ from those of your jurisdiction. By using the Website, you consent to such transfer, storage, and processing.

12. DO NOT TRACK SIGNALS

Some web browsers transmit “Do Not Track” (DNT) signals. At this time, Protide Health does not respond to DNT signals because there is no industry-wide standard for such signals. We will update this Privacy Policy if a uniform standard is established.

13. CHANGES TO THIS PRIVACY POLICY

Protide Health reserves the right to modify or update this Privacy Policy at any time. Material changes will be indicated by updating the “Last Revised” date at the top of this document. We encourage you to review this Privacy Policy periodically. Your continued use of the Website after any changes constitutes acceptance of the updated Privacy Policy.
